breathARMY Participant Agreement

Introduction
Welcome to a breathARMY Event. This Participant Agreement ("Agreement") applies to all participants ("Participant" or "I") registering for our events, including but not limited to breathwork, workshops, movement or ecstatic dance, and sound healing ("Events"). By clicking the checkbox on the checkout page, I acknowledge that I have read, understand, and agree to be bound by the terms and conditions set forth below.

Agreement to Follow Directions
I agree to observe and obey all rules and warnings provided by breathARMY, and to follow any instructions given by the event organizers, employees, or representatives. I understand the importance of practicing the techniques taught in a safe and appropriate environment and agree not to engage in any activities that could lead to harm to myself or others.

Waiver of Liability
I acknowledge that participation in the Events involves inherent risks and dangers of injuries or damages, such as physical injury, mental stress, or even death, that may arise from my own actions, the actions of others, the conditions of the event sites, or the negligence of breathARMY. I hereby agree to release, waive, discharge, and covenant not to sue breathARMY, its officers, employees, and agents from any and all liabilities, claims, actions, damages, costs, or expenses of any nature whatsoever for any injuries, property damage, or losses that I may have or which may hereafter accrue to me, arising out of or in connection with my participation in the Events.

Health and Safety Requirements
I confirm that I am in good physical and mental health, suitable for participating in the Events. I agree to notify the event organizers of any pre-existing conditions or disabilities that might affect my participation. I understand that it is my responsibility to ensure my own health and safety during the event. 

Cancellation and Refund Policy
I understand that breathARMY reserves the right to cancel any Event due to insufficient enrollment, inclement weather, or other circumstances beyond our control. In such an event, I will be notified as soon as possible and given the option to transfer to another event or receive a full refund. I acknowledge that if I cancel my registration, refunds or credits will be given according to the following schedule: within one week of the event date will receive a full refund, up to 2 days prior to the event will receive a 50% refund, within 48 hours of the event will not receive a refund. In cases of 50% or no refund an event credit may be considered at the discretion of breathARMY - please inquire.

Code of Conduct
I agree to conduct myself in a manner that is respectful to all participants, staff, and property. This includes not engaging in any behavior that is disruptive, dangerous, or violates the rights of others. I understand that failure to adhere to this code of conduct may result in my removal from the event without refund.

Media Release
I understand that during the Events, I may be photographed or recorded. I hereby grant breathARMY the right to use my image, likeness, and sound of my voice as recorded on audio or video without payment or any other consideration. I understand that my image may be edited, copied, exhibited, published, or distributed, and waive the right to inspect or approve the finished product.

Medical Consent and Release
In the event of an emergency, I authorize breathARMY to secure emergency medical care or transportation. I agree to be responsible for any expenses incurred and release breathARMY from liability for seeking such care.

Data Protection and Privacy
breathARMY commits to protecting the privacy and security of my personal data. The data collected will be used to process event registration and for future communication. I understand my rights under applicable data protection laws and can request access to or correction of my personal data.

Email Marketing Consent
I consent to be added to breathARMY's email list for future event promotions and newsletters. I understand I can unsubscribe at any time by clicking the unsubscribe link in any email communication.

Severability
If any provision of this Agreement is found to be invalid or unenforceable, the remaining provisions will continue to be fully effective.

Governing Law.
This Agreement shall be governed and interpreted in accordance with the laws of the Canada (without regard to the choice of law or conflicts of law principles). In the event of a dispute arising out of or in any way relating to this document or Events to which it refers, jurisdiction and venue shall be the courts of British Columbia and only in those courts. The parties irrevocably waive any objections or defenses based on lack of personal jurisdiction, improper venue, or forum non convenience. To the extent allowed by law, the parties waive their right(s) to a jury trial in any action arising out of or in connection with this document or Participants to which it refers. The parties further agree that any claims, disputes, or actions of any kind shall be resolved individually and without resort to any form of class action.

Acceptance of Terms
By clicking the checkbox on the checkout page, I confirm that I have read this Agreement and fully understand its terms. I acknowledge that I am giving up substantial rights, including my right to sue. I further acknowledge that my agreement to these terms is a complete and unconditional release of all liability to the greatest extent allowed by law.
